1. Purpose of this Privacy Policy

Asian Honda Motor Co., Ltd. (the "Company" “we” “our” or “us”), a limited company incorporated under Thai law committing to secure privacy and gain your trust. This Privacy Policy informs you how the Company collects, uses or discloses your personal data, including the purposes for doing so. The personal data collected by the Company, your rights as a Data Subject and disclosure of personal data to third parties including how to contact the Company.

This Privacy Policy applies to the collection, use and/or disclosure of your personal data during the recruitment process job interview since you started working with the Company and during work. This includes, but is not limited to cases where you are a job applicant, job interview, current and former employees, employees who have been transferred from a subsidiary of Company to work for the Company, employees who temporarily work at other units (Secondment), employees, trainees, executives, current directors and former directors of the Company, persons nominated as directors, authorized persons acting on behalf of other companies (such as attorneys) as well as other persons related to the above persons with whom we have received personal data from the above persons.  


2. Personal data collected by the Company

In this Privacy Policy "personal data" means any information about an individual that enables that person to be identified either directly or indirectly or as defined in the applicable personal data protection law. The Company collects, uses and discloses your personal data. (This may include sensitive personal data) based on interactions the Company has with you which may include, but is not limited to the following information:

Identifiable information such as name, surname, date of birth, age, gender, marital status, nationality, tax identification number, weight, height, military status, family status, living status, details of spouse and children, number of children, number of siblings, parents, sibling order, photographs, audio recordings, video recordings and/or audio of you or signature,

Contact information such as residential address, current address, E-mail address, home phone number, mobile phone number, application account or communication platform,

Information in government-issued documents or other documentary evidence, such as information and/or copies of identification cards, passport, driving license, car plate number, house registration, social security card, military evidence, marriage certificate (or any other proof of marriage), birth certificate, death certificate, ordination certificate,

Financial information such as income, bank account details, bankruptcy information,

Educational background/qualification information, skill, work history such as a resume (CV/resume), educational history (ex. education level, name of educational institution year of study Graduation year Faculty/Major Grade GPA, proof of educational qualifications), work history (ex. company or employer name start date termination date, position, responsibilities, salary including payslip, employment certificate, reason for leaving the job), skills and abilities (ex. ability to use computer programs, language proficiency ability to drive a vehicle Typing ability), training history, job position that you want to apply to work with the Company,

Work-related information, such as position, start date, responsible work, work history and results, time to work and time to leave work, leave allowance, employee status, information about the salary, compensation (ex. salary rate, salary adjustment information) and various benefits, positioning information, information about the use of welfare rights and benefits and supporting documents,

Security information such as image, personality of a person, suspicion or unusual activity, recorded by CCTV which can be both still images motion pictures and sound,

Sensitive personal data such as religious information (indicated on a copy of your ID card or in other cases), health information, criminal record information (Information about the offenses according to the Law as you specify in the job application documents or from inspections with government agencies (such as the Royal Thai Police)) and biometric data,

Other information such as records of interactions and communications between you and the Company either in any form or by any means, any other information that you provide or that the Company obtains from outside parties or entities during the recruitment process, job interview, since you started working with the Company, during work or support to work. This may include a job application, document relating to the welfare provided by Company and other documents,

In the case of the Company has used information other than personal data together with personal data related to you which makes the Company can identify you, in that case, the Company will treat information other than personal data as the same way the Company treats personal data relating to you.


3. Personal data of third party related to you

The Company may collect the personal data stated above from you about third parties to you such as your spouse, children, family members, references or emergency contacts. If and when you provide personal data of third parties related to you to the Company, you represent and warrant that you have the authority to provide such personal data to the Company in the following manner:

For recruitment management, for example to review and process job applications, references and documents that you have given to assess your qualifications and suitability for employment during the hiring or recruiting process. This includes verifying your identity in accessing Company premises (such as the use of closed-circuit television cameras, registration, card redemption and/or use of any other authentication system), establishment, use, comply with, or raise. The collection of personal data is only necessary for consideration of the application or recruiting people to become personnel of the Company or to comply with legal or contractual requirements or for the Company's business operations. In the event that the Company is required to collect personal data by law or to enter into or perform a contract that the Company has with you, but you do not agree to provide personal data to the Company including in the event that you do not give consent to the collection, use and/or disclosure of personal data for purposes for which the Company requires your consent. The Company may not be able to process your application or recruiting you to become the personnel of the Company or proceeding to enter into a contract with you or performing duties under the said contract or continue to perform duties as prescribed by law.


4.2. Methods of Collecting personal data

The Company collects personal data from you directly from you through various channels such as filling out forms or documents you submit to the Company, telephone, fax, e-mail, Company human resource systems, applications or platforms for communication or other channels that you use to communicate with the Company including the use of CCTVs in the Company's premises. In some cases, the Company may collect your personal data from other sources. This includes but is not limited to the following cases:

The Company may collect personal data from persons associated with you, such as spouse, children, family members, references or emergency contacts,

The Company may collect personal data relating to you from government agencies or law enforcement agencies such as the Royal Thai Police.


4.3. Grounds to collect, use or disclose personal data

In general, the Company collects, uses or discloses your personal data under the following legal bases,

In case of necessity to perform a contract which you are a party to the Company or to perform various steps at your request prior to entering into a contract with the Company (for example, any actions related to entering into an employment agreement, compliance with the employment agreement, any requests related to the above agreement or any other agreements that you have entered into with the Company),

In case of necessity for the legitimate interests of the Company or of a third party, whereas such benefits take precedence over your fundamental rights to your personal data,

5. Minors, incompetent persons and quasi-incompetent people

7. Overseas data transfer

The Company may send or transfer your personal data to Honda Group outside Thailand for the purposes set forth in this Privacy Policy. In such cases, the Company will obtain your consent or comply with other relevant provisions of law.

The Company is entitled for a legitimate interest (for example, for the performance of a contract), to the extent permitted by the provisions of the relevant law.

In such cases, the Company takes appropriate procedures for transferring your personal data outside the country in accordance with the data protection laws of Thailand.

In the event that your personal data is transferred to a person or entity located in the designate country that has not yet been determined by the Personal Data Protection Committee that there is adequate personal data protection standard in accordance with the data protection act of Thailand, the Company will take necessary measures to protect your personal data that are transferred to others outside the country in accordance with the standards of personal data protection that the Company has taken with your personal data in accordance with the law on personal data protection of Thailand that is in force at that time.


8. Security

The Company takes appropriate organizational, technical, physical and administrative measures to protect personal data under its control from destruction, loss, access, use, alteration or disclosure whether by accident unlawful or without permission. This includes accessing or controlling access to personal data to maintain a secret completeness and the availability of personal data under the Company's control, in accordance with the minimum requirements required by law. However, the transmission of information via the Internet or storage systems cannot be completely secured.

The Company has arranged the measures to control access to personal data and the use of equipment for storing and processing personal data that is safe and appropriate for the collection, use and disclosure of personal data. The Company has also put in place measures to limit access to personal data and the use of devices for storing and processing personal data by specifying access rights to the user's data, the right to authorize designated employees to access information and the responsibilities of the user. 9. Period of retention of your personal data

The Company has the right to collect and use your personal data collected before the date of the Personal Data Protection Act B.E. 2019 according to the original objectives of the Company. 11. Your rights as the Data Subject of personal data

When the law on personal data protection has come into force in Thailand, you have the right to take any action as required by law regarding your personal data, the following:

Right to withdraw consent, where you have the right to withdraw your consent for collection, use and disclosure personal data that you have given consent to the Company throughout the period your personal data is with the Company. Unless there is a limitation of the right to withdraw consent by law or contract that benefits to you. However, withdrawing your consent will not affect the collection, use or disclosure personal data that you have legally given your consent,

Right to access personal data, whereby you have the right to access your personal data and ask the Company to make a copy of such personal data for you including asking the Company to disclose the acquisition of personal data that you did not give consent to the Company,

The right to rectify of personal data, whereby you have the right to request that the Company correct, add or update your inaccurate personal data or not current data that may cause misunderstandings,

The right to erase personal data, you have the right to request that the Company delete, destroy or make your personal data non-identifiable in accordance with the terms required by law. Unless the law allows the Company to collect your personal data, for example to establish a claim, comply with or apply for a claim or fighting rights claims or comply with the law,

However, you are legible to lodge a complaint to the relevant legal authority.

To submit a request for action under the above rights, will not be effective immediately. The Company will endeavor to process your request as soon as it is practicable, in any event not exceeding the period required by applicable law to comply. However, the Company may refuse to exercise your aforesaid rights if the rules set by the company is not contrary the law.


12. Updates to Privacy Policy

The Company will review the Privacy Policy on a regular basis to ensure it is consistent with applicable practices and laws and regulations. The Company therefore reserves the right to amend this Privacy Policy from time to time. The Privacy Policy as amended will appear in the channels specified by the Company and will supersede all prior Privacy Policies. If you want to know about the changes, the Company recommends that you follow the Privacy Policy in the channels specified by the Company. Such revisions will be effective as soon as the Company has published the Privacy Policy as revised in the Company's internal system or any other channels as the Company deems appropriate.
